Each time a purchase order is placed through this website, a purchase contract shall be formed between the user and BODEGA OTAZU S.A.U. Said contract shall be governed by these General Terms and Conditions.


HOW THE STORE WORKS

The Store works like a supermarket cart. Just click on [Añadir al carrito] and the product will be added to your cart (you can always delete it later if you want).

If you want more information about the product, click on the image of the bottle of wine, the article or the case or box and you will find more information about it.

All bottles have a capacity of 75 cl. unless otherwise indicated. In the event that a particular vintage is out of stock, it will be replaced by the one that is commercially available.

When purchasing, please note that:

  • Exclusive sales in mainland Spain and Balearic Islands

  • The languages in which the products offered through its online store are contracted shall be Spanish and English.

  • All products are shown with V.A.T. already applied.

  • When you place your order, we will show you a detail of the prices without VAT and the amounts corresponding to the taxes according to the rate in force on the day of the order.

  • There is no minimum or maximum order quantity.

  • Free shipping on wine purchases over 100€ for shipments to the Peninsula & Balearic Islands.

  • For purchases of less than 100€, shipping costs will be charged according to the following table:

  • When you have finished choosing the products you wish to purchase you can proceed to ‘Place order and pay’.

  • The store allows you to buy without registration, just by providing an email address, but we recommend that you register so that you don’t have to fill in your details every time you buy. Also to receive exclusive offers or limited collections.

  • In the “My account / My orders” section of this website you can check the status of your orders at any time. To access this section it is necessary to enter the email address provided at the time of purchase and the password sent to you by email.

  • You will receive a paper invoice with your order.


PAYMENT SYSTEMS

CREDIT CARD

We guarantee that every transaction made at www.otazu.com is secure. All operations involving the transmission of personal or banking data are performed using a secure environment. Your credit card information is not recorded in any database, but goes directly to the bank’s POS (point-of-sale terminal).

When paying with VISA, Mastercard or American Express, you will be asked for the following information: the card number, the expiration date and a validation code that matches the last three digits of the number printed in italics on the back of your card.

In addition, for additional security, you will be asked for a personal password for exclusive use for Internet purchases, which must have been provided by your bank.

PAYPAL

In our store you can also use this popular service to make or receive online payments.


SHIPPING

We guarantee delivery to the carrier the day after receipt and conformity of the order if it is a working day, in the case of non-working days the order will be processed the first working day after the day of its realization. In addition, it should be taken into account that deadlines are calculated in working days and may be altered by local or national holidays.

The estimated delivery time to the Peninsula and the Balearic Islands is 48 hours.

If your order does not arrive within the estimated period please contact us and we will make the necessary arrangements to deliver it in the shortest possible time.

If you are not at home at the time of delivery, the carrier will leave a note for you to contact them to arrange a new delivery time. It is important that, upon receipt of the order, before signing the delivery note, you check that the bottles have arrived in good condition. If not, make the corresponding notification on the delivery note prior to your signature.


CONTRACTUAL RIGHT OF WITHDRAWAL

If you are contracting as a consumer, you may withdraw from the contract at any time within 14 working days from the date of delivery of your order and without giving any reason. No refunds will be accepted for cancellation by companies or freelancers. The reimbursement of the amount initially paid (product + shipping costs) shall be made within 14 days of receipt of the goods by BODEGA OTAZU S.A.U., through the means of payment used in the purchase. Return transport costs shall be borne by the customer.

Prior to the return, the customer must indicate its intention to withdraw by sending a document that reflects the intention of the customer to make use of the right of withdrawal or you can make use of the form that can be downloaded here (or, if you prefer, in PDF) by sending it to the seller, either by mail or email. BODEGA OTAZU S.A.U. will reply specifying the precise instructions for returning the product.

The return cannot take place in any case if the bottles have been opened.

The products must be returned correctly protected, in their original packaging, in perfect condition (not damaged or soiled by the customer).

They will be sent to the place specified by BODEGA OTAZU S.A.U. in the precise instructions for the return of the product sent by e-mail.

Packages that do not have any enclosed elements that allow the sender to be identified (order number, name, address, etc.) cannot be returned.

The customer who returns a product will receive an email informing him/her of the amount of the refund.


RETURN OF DEFECTIVE PRODUCTS

In cases where you consider that at the time of delivery the product does not conform to the Contract, you should contact us immediately, indicating the damage to the product. Call the phone number or write to the e-mail address above and we will tell you how to proceed.

Once we receive the returned product, we will examine it, and we will inform you by e-mail, within a reasonable period of time, if the product is to be returned or replaced.

The amounts paid by the customer in those cases in which the return is effectively due to a defect or defect, will be refunded in full, including the cost of return. The refund will be made in the same payment method used to pay for the purchase.

RETURN OF WRONGLY SHIPPED PRODUCTS

Your data will be kept for as long as there is a business relationship and a mutual interest in maintaining the purpose of the processing and when it is no longer necessary for that purpose it will be deleted with appropriate security measures.

You declare that all the information or data you provide us are true and correspond to reality.

As a user of www.otazu.com you can receive information on activities and news from BODEGA OTAZU S.A.U. (if you have checked the corresponding box on the registration form). However, if you change your mind about whether you wish to receive communications, you can access your registration form at any time once you have logged in as a user, and access the ‘my details’ section, or you can let us know by contacting our customer service department indicated at the beginning of this document.

You can revoke the consent given for the treatment, exercise your rights of access, rectification, deletion, portability of your data and limitation or opposition to its treatment, through the email above or at the postal address above. You must attach a copy of your ID card. You also have the right to file a complaint with the supervisory authority (aepd.es) if you consider that the processing does not comply with the regulations in force.

The data of the receiver of the goods (name, address, telephone number, etc.) will be provided to the cooperating carrier. The data provided are strictly necessary for this purpose. The necessary communications with the bank to complete the transaction will also take place. No other communication will be carried out, except in the cases established by law. JURISDICTION AND APPLICABLE LAW

In case of disputes in the interpretation or application of these contractual conditions, in the case of end consumers, the courts of the domicile of the purchasing party shall have jurisdiction. If the customer is domiciled outside Spain, as well as if the customer is a company or self-employed, both parties expressly waive any other jurisdiction, submitting to the Courts and Tribunals of Pamplona (Navarra-Spain).


VIRTUAL POS

This merchant agrees not to allow any transaction that is illegal, or is deemed by the credit card brands or acquiring bank, that may or has the potential to damage their goodwill or negatively influence them. The following activities are prohibited under the card brand programs: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Purchaser, Issuing Bank, Merchant, Cardholder, or cards. In addition, the following activities are also explicitly prohibited: “Sale of alcoholic beverages to persons under 18 years of age”.
