Each time an order is placed through this website, a purchase and sale contract will be entered into between the user and BODEGA OTAZU S.A.U., governed by these General Terms and Conditions of Contract and by Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users (LGDCU).
Purchase Process
The purchase process is carried out entirely in Spanish and English. To purchase products, the user must add them to the cart, review the order, provide the shipping and payment details, and confirm the purchase. Once the order is confirmed, the user will receive a confirmation email with its summary.
All bottles have a capacity of 75 cl unless otherwise indicated. In the event that a particular vintage is out of stock, it will be replaced by the commercially current vintage, after prior notice to the customer.
Conditions applicable to all orders:
- Sale and shipping exclusively to mainland Spain and the Balearic Islands.
- No shipments are made to the Canary Islands, Ceuta or Melilla.
- Prices shown include VAT according to the rate in force at the time of the order.
- No minimum or maximum purchase amount.
- Free shipping for orders over €100 destined for the mainland and the Balearic Islands.
- For orders under €100, the shipping costs indicated in the purchase process will apply.
The purchase can be made without prior registration, providing only an email address. Registration is recommended to facilitate future purchases and to access the order history in the "My Account" section.
Prices and Taxes
All published prices include the Value Added Tax (VAT) applicable in accordance with current Spanish legislation. At the payment stage, the amount excluding VAT and the corresponding tax charge will be broken down. BODEGA OTAZU S.A.U. reserves the right to modify prices at any time, with the price in force at the time the order is placed applying.
Payment Methods
Card payments are processed through a secure payment gateway (Stripe) with SSL/TLS encryption. Card data is never stored by BODEGA OTAZU S.A.U. We accept VISA, Mastercard and American Express. The system applies the Strong Customer Authentication (SCA) protocol required by the European Payment Services Directive PSD2 (Directive 2015/2366/EU), so additional verification may be requested via 3D Secure.
Shipping and Delivery
Shipments are made exclusively to mainland Spain and the Balearic Islands. No shipments are made to the Canary Islands, Ceuta or Melilla.
Orders received and confirmed on a working day will be handed to the carrier the following working day. Orders placed on non-working days will be processed on the first subsequent working day. The estimated delivery time for the mainland and the Balearic Islands is 48 business hours from handover to the carrier.
BODEGA OTAZU S.A.U. is not responsible for delays caused by the carrier or by circumstances beyond its control (strikes, natural disasters, local or national holidays, etc.). In the event of a significant delay, the customer can contact us to manage the incident.
On receipt, the customer must check the condition of the order before signing the delivery note. If external damage is observed, it must be noted on the delivery note before signing it.
Right of Withdrawal (Products)
In accordance with Article 102 et seq. of Royal Legislative Decree 1/2007 (LGDCU), in product purchases the consumer has a period of 14 calendar days from receipt of the order to exercise the right of withdrawal without the need for justification. This right does not apply to companies or self-employed persons acting in the course of their professional activity.
To exercise withdrawal, the customer must notify BODEGA OTAZU S.A.U. before the expiry of the period, by means of an unequivocal statement (email to info@otazu.com or postal letter). The standard withdrawal form provided in Annex B of RDL 1/2007 may be used, although it is not mandatory.
The refund of the amount paid (product and original shipping costs) will be made within a maximum of 14 calendar days from receipt of the withdrawal notification, through the same payment method used in the purchase. Return shipping costs are borne by the customer.
The right of withdrawal will not apply if the bottles have been opened, since these are goods that by their nature cannot be returned (Article 103.d LGDCU). Products must be returned in their original packaging, in perfect condition and with identification of the sender.
Cancellation of Experiences and Visits
Visits, tastings and wine tourism experiences are leisure services with a specific date and time of execution. In accordance with Article 103.l) of RDL 1/2007, the 14-day right of withdrawal does not apply to this type of service. Instead, the following cancellation policy applies, calculated with respect to the start date and time of the booked experience:
- More than 48 hours in advance: refund of 100% of the amount paid.
- Between 24 and 48 hours in advance: refund of 50% of the amount paid.
- Less than 24 hours in advance or no-show: no right to a refund.
To cancel an experience, the customer must notify info@otazu.com indicating the reservation details. The corresponding refund will be made through the same payment method used in the purchase. If Otazu is forced to cancel or reschedule an experience for reasons of its own, the customer may choose between a new date or a full refund of the amount.
Legal Guarantee and Defective Products
In accordance with Royal Legislative Decree 1/2007 and Directive (EU) 2019/771 on contracts for the sale of goods, the consumer has a legal guarantee of three years from delivery of the goods to claim for lack of conformity. During the first 12 months, the defect is presumed to have existed at the time of delivery.
If the product received has a defect or does not match the order, the customer must contact us at info@otazu.com or at 948 329 200 immediately. BODEGA OTAZU S.A.U. will assume all return and replacement costs in these cases.
Online Dispute Resolution
In accordance with Regulation (EU) 524/2013 on online dispute resolution for consumer matters, EU consumers can access the European Commission’s online dispute resolution platform at: ec.europa.eu/consumers/odr. The contact email of BODEGA OTAZU S.A.U. for these purposes is info@otazu.com.
Complaint forms are available to the public at the company’s registered office. For disputes not resolved directly with us, the customer may resort to consumer arbitration or the competent courts according to the applicable jurisdiction.
Data Protection
The personal data provided during the purchase process will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 of 5 December on Personal Data Protection and guarantee of digital rights (LOPDGDD). For more information, please see our Privacy Policy.
Applicable Law and Jurisdiction
These terms are governed by Spanish legislation. For the resolution of disputes, in the case of final consumers the courts of the buyer’s domicile shall be competent. If the customer is a company or self-employed, both parties expressly submit to the Courts and Tribunals of Pamplona (Navarra).
